Hemp and THC shops are closing under new state laws, with a federal deadline next

At least 12 hemp and THC retailers closed or announced closings in 2026 and pointed to new state or federal rules on THC products. Together they covered 21 storefronts in 8 states. They came in waves as each state's law took effect: Texas in the spring, Tennessee in the summer, Virginia in August. A federal change is next. Under a law signed in September, most of the new federal limits on hemp-derived THC products apply from December 11, 2026.

Why they are closing

The shops tie their closings to a specific law, and say so.

  • Tennessee. Gold Spectrum said it would close "all eight of its East Tennessee locations, eliminating 121 jobs as a state grace period allowing the sale of certain hemp products comes to an end," WVLT reported.
  • Virginia. Store manager Lindsay Diaz told the Chatham Star-Tribune that ownership decided to close all three of THE Dispensary's Virginia stores "because of the change in state law."
  • Iowa. Despensary in Des Moines is "a casualty, owners say, of Iowa's overly restrictive laws on THC products."
  • The cost of complying. Burning Acre in Columbia, TN said its "current annual cost to manufacture, distribute and run its retail shop is about $750, but the new rules would raise costs by tens of thousands of dollars," WSMV reported.
  • The federal change. Herban Flow is closing a St. Petersburg, FL store "as its owners prepare for a federal law that could eliminate the products responsible for roughly 80% of the St. Petersburg retailer's sales," the St Pete Catalyst reported.

Named examples beyond the table above:

  • Gold Spectrum, eight East Tennessee stores including Bristol, TN, set to close as the state's grace period for THCA sales ended June 30.
  • THE Dispensary in Danville, Chesterfield and Fredericksburg, VA; last day August 14.
  • Phantom CBD in San Antonio, TX: "the new rules have effectively ended operations... 'There were four employees, four friends of mine.'"

The federal deadline

The federal change began with a spending law signed November 12, 2025 (Public Law 119-37), which rewrote the federal definition of hemp. The new definition takes effect November 12, 2026. A funding law signed September 2, 2026 (Public Law 119-103, section 2019) limits it, until December 11, 2026, to products containing cannabinoids the hemp plant cannot produce naturally. From December 11, the rest of the new limits apply, including a cap of 0.4 milligrams of total THC per container on final products.

What we counted

We count retailers that closed or announced a closing in 2026 and whose source ties the closing to state or federal THC rules. A chain counts once, and its stores are counted as storefronts. Shops that were only threatened, that restructured, or that appear only in a lawsuit are left out, as are forecasts of closings that haven't happened. A closing date is printed only where a source states one.

These are named examples, not a measure of the market. We don't hold a count of all hemp retailers, so we can't give a share or a rate.

This page will be updated as more closings are recorded. Each update will be dated in the changelog below.
